An individual filed a civil complaint on Thursday, September 12, 2013 in the Common Pleas Court of Franklin County, Ohio seeking to halt Columbus’ Photo Traffic Enforcement System as being in violation of Ohio’s Constitution.
The complaint alleges the system established by Columbus City Code 2115 is invalid and unenforceable because it fails to provide car owners adequate due process under Ohio’s Constitution and wrongfully divests the Franklin County Municipal Court of jurisdiction to adjudicate traffic violations. The suit seeks an injunctive relief precluding the city from further enforcement of traffic fines arising out of the photo system and also seeks to permanently enjoin the city from using the system to fine car owners. The suit further seeks restitution on behalf of all of those who paid fines to the City of Columbus.
